Kebs snubs re-test order for fertiliser

Collection of samples of the controversial fertiliser suspected to contain mercury flopped for the second time on Wednesday.

This was after Kenya Bureau of Standards (Kebs) failed to send its officials to Bollore Logistics godown in Changamwe, Mombasa, for the exercise.

The accused persons, among them Kebs former managing director Charles Ongwae and 10 other officials, waited for the agency’s officials to get the samples but left disappointed.

Mr Ongwae and the co-accused are facing charges of attempted murder over the importation of the fertiliser alleged to have had traces of mercury.

Milimani Principal Magistrate Kennedy Cheruiyot has issued an order directing the two parties to have the samples collected on February 20 and the tests conducted on February 21.

The parties were set to return to court on March 13 for confirmation of compliance with the orders.

However, yesterday, Senior Counsel Paul Muite faulted Kebs terming the act contempt of court. Mr Muite is representing the accused persons.

“The orders were clear that the samples be taken at 10am but we have waited for two hours and none of them has shown up. What are they trying to hide? That is the big question,” said Mr Muite.
